I. APPLICATION

1. Our General Terms and Conditions of Sale apply to every offer from us as a merchant to you as a customer.

2. We deliver within all countries of the European Union. If a delivery address in another country is specified, we reserve the right to refuse this order.

3. Placing an order on our website implies the express acknowledgement of our General Terms and Conditions of Sale that are available on the website.

4. If you place an online order, a copy of these General Terms and Conditions of Sales will be provided in a format that you can print or save together with the order confirmation. It is recommended to keep this copy for future reference.

5. If any additional Special Conditions are applicable in addition to this General Terms and Conditions of Sale, the Special Conditions will take priority. 


II. OUR OFFER AND YOUR ORDER

1. Our goods are described as completely and accurately as possible, in order to let you make a proper assessment. If graphics are used, they are a true reflection of the goods. However, in case we made an obvious mistake in the description, we are not obliged to deliver the order if this would prove impossible. 

2. Once we confirm your order by email and/or receive payment, the contract between us is final. We accept credit cards (American Express, Discover, MasterCard, VISA), Bancontact (in Belgium) and bank transfers. Orders without valid payment will not be processed or accepted.

3. BORN TO BLESS goods are only sold to individuals for personal use, not to businesses and/or for resale.


III. RIGHT TO RECALL

1. Within 14 calendar days after delivery, you have the right to return BORN TO BLESS goods. Your order can be overruled without paying a fine and returned without giving any reason. However, the transport costs for the return shipment will be covered by yourself. Within 10 working days following your notification that you will return the good(s), we will refund the full purchase price via the payment method you chose when ordering the product. 

2. Returned goods can be unpacked, may have been fitted, but must not be used, except to the extent necessary to assess whether you want to keep the goods or not.  If you wish to send back the goods, this should be done together with the original packaging, accessories and in the original condition.

3. Your package can be returned via registered mail or courier, or the goods can be brought to BORN TO BLESS, Rue du Fossé aux Loups 28A, 1000 Brussels, BELGIUM.


IV. PRICE

1. Our prices will not change during the timeframe mentioned in our offer, except for price changes resulting from changes in tax rates.

2. All taxes, VAT and services are included in our prices. Shipments costs are calculated separately and are covered by the customer.


V. PAYMENT

1. We accept payment via the payment module on our website.

2. In order to ensure the security of your personal data and online payment, transaction data is sent encrypted with SSL technology. A secure SSL connection can be recognized by the “lock” symbol.


VI. COMPLIANCE GUARANTEE

We guarantee that our good(s) meet all legal requirements and that they are in accordance with your order and correspond to the specifications provided on our website.


VII. DELIVERY

1. All purchased goods will be delivered to the address specified by you when placing your order. Delivery is possible to any address within the European Union during working days. 

2. We will inform you about the details of delivery in the order confirmation. 

3. Shipment is done via Sendcloud.

4. In case of unsuccessful delivery, the good(s) will be returned to BORN TO BLESS. 30 working days upon return at the latest, your order will be refunded after deduction of any additional shipment costs.

5. Any information relating to deliveries can be requested via hello@born-to-bless.be.

6. Shipments are at our risk as merchant except if you return goods.

7. If goods are damaged during transport or do not match the items you ordered, you must report this as soon as possible and within 3 calendar days after delivery at the latest. Non-conforming articles must be returned to us within 14 calendar days after receipt. 

8. We are not liable for any consequential damage as a result of late delivery or non-delivery by the carrier designated by us. Our liability in such cases is limited to the value of the items not received by the customer.


VIII. FORCE MAJEURE

1. In case of force majeure we are not obliged to fulfill our obligations. In that case we can suspend our obligations for the duration of the force majeure circumstance or terminate the agreement definitively.

2. Force majeure is any circumstance beyond our control which prevents the full or partial fulfillment of our obligations, including but not limited to fire, strikes, business interruptions, power failures, stock failures, failures in (telecommunication) networks or connections or used communication systems.


IX. INTELLECTUAL PROPERTY

1. Our website, photos, texts, logos, names and in general all our communications are protected by intellectual property rights that either belong to us or to our suppliers or other entitled parties.

2. It is prohibited to use or make changes in these intellectual property rights. For example, drawings and photographs, texts, logos, color combinations, etc... may not be copied or reproduced without our prior express written consent.


X. PRIVACY

Our privacy statement provides information about how BORN TO BLESS will use your information. Acceptance of these terms and conditions implies acceptance of the privacy statement.


XI. COMPLAINTS AND COMPETENT COURTS

1. We do our utmost to fully satisfy all our customers. However, if you have a complaint about our service please contact us via email hello@born-to-bless.be. or via your customer account page. We will deal with your complaint within 7 working days.

2. All our contracts with customers are governed by Belgian law and any disputes are subject to the jurisdiction of the courts of Brussels.
